Guide to Debt Collection Scams and Fraud

Knowledge can protect you better than a strong castle. Safeguard your information.

As we get more and more digitally interconnected, scams and fraud targeting the collection industry have grown. This includes credit card, subprime loans, payday loans, and medical debt. These fraudsters often make harassing phone calls or even threaten consumers. This informational page was created to assist you in determining when you are possibly being scammed and what to do about it.

We value our customers and clients and strive to protect them with the latest secure technologies and safety measures. The tips below will help you determine if the company you are dealing with is legitimate and trustworthy. Please read on for helpful information in determining if a communication from a debt collector is legitimate or a debt collections scam.

Debt Collectors Do’s

We strive to make sure you experience with us is productive and positive. There are many different options we offer to help you take care of this matter and there is never any pressure. We value each and every customer and train all of our agents to work with you.

The federal government has created the Fair Debt Collection Practices Act (FDCPA) to define the rights of consumers and govern how debt collectors may conduct business. Halsted Financial Services and its employees are committed to abiding by the FDCPA and all applicable federal and state regulations

Debt Collectors Must:

  • Verify that they are speaking with the customer or an authorized 3rd party before continuing to discuss the account. This is to protect information about your debt from being disclosed to anyone else.
  • Identify themselves by name and company. Ex: This is Mary from Halsted Financial Services.
  • Provide you with information as required by state and federal law.
  • The complete text of the FDCPA may be found at here.

Debt Collectors No-No’s

Legitimate and professional debt collectors will never harass you. Their goal is to speak with you and make sure you are aware of the full line of options available to you. They want to help you resolve an outstanding balance. Licensed and reputable debt collectors will not:

  • Threaten you with arrest, jail or physical harm
  • Use obscene or profane language
  • Threaten to freeze your assets without due process
  • Continue to call if they know you are represented by an attorney
