Debt Collectors Do’s

The federal government has created the Fair Debt Collection Practices Act (FDCPA) to define the rights of consumers and govern how debt collectors may conduct business. Debt Collectors Must:

  • Verify that they are speaking with the customer or an authorized 3rd party before continuing to discuss the account. This is to protect information about your debt from being disclosed to anyone else.
  • Identify themselves by name and company. Ex: This is Mary from Halsted Financial Services.
  • Provide you with information as required by state and federal law.

Debt Collectors No-No’s

Legitimate and professional debt collectors will never harass you. Their goal is to speak with you and make sure you are aware of the full line of options available to you. They want to help you resolve an outstanding balance. Licensed and reputable debt collectors will not:

  • Threaten you with arrest, jail or physical harm
  • Use obscene or profane language
  • Threaten to freeze your assets without due process
  • Continue to call if they know you are represented by an attorney
